When Health Consulting Businesses are Legally Responsible

One thing the internet is infamous for is being a source of advice for our health and well-being.

It doesn’t matter where we turn there is someone with a website telling us what to do to lose weight, slow down ageing or treat our illnesses.

We all do it. We aren’t feeling well so we type our symptoms into “Dr. Google” and voila, thousands of results telling us we have everything from a common cold to 6 months to live. We then take our results in hand to our doctor and tell him what we have.

Sadly, professionals in the health care industry, doctors, therapists, dieticians and nutritionists all have an everyday fight with misinformation that is provided on the internet.

If you are a blogger and have some experience with health-related issues, you may want to share this information with the world.

Or, you may be a professional with some education on certain health-related subjects and want to use that information to boost your business online.

Either way, you have to be very careful to follow the rules when it comes to providing health and wellness website information and advice to the masses.

Legal Responsibilities for Providing Health-Related Advice

So what are the legal issues for health consulting and coaching businesses when providing health-related information on a website?

There have been more than a few lawsuits in past years that have stemmed from sharing of health and diet advice with others on the internet.

In a recent lawsuit in North Carolina, a blogger changed his life and had experience with managing his Type 1 diabetes through use of the Paleo diet. He blogged about his efforts and when successful, he took his blogging a step further and began to share his meal plans and exercise regimens.

Eventually, he began providing one on one sessions to advise his readers in the ways of his experience for a fee.

In North Carolina, there is a misdemeanor law that makes it unlawful to practice dietetics or nutrition without a license. This blogger was charged with breaking this law and North Carolina Board of Dietetics/Nutrition is now threatening him with prison.

Research All Governing Bodies’ Rules & Regulations

When providing health and wellness information online, you must ensure you are following all the rules.

Each governing body has separate rules on what information you can and cannot advise the public with regarding their health.

Canada and the United States both have specific federal laws and then each province and state also have their own separate laws.

If you are going to provide information, then you must look up those laws according to where you live and where you are doing business from. And to take it even a step further, you then you have to consider the audience you are targeting.

A good guideline to follow if you are providing information on your health-related website is to ask yourself, are you being specific to a particular personal health situation. The blogger in the North Carolina lawsuit was doing OK with providing his personal experiences with the Paleo diet.

His suggestions for exercise regimens or providing his personal diet plans on his health and nutrition website may even have been OK with the law but as soon as he started consulting one-on-one with individuals and providing advice, he was beyond sharing his personal experience and fell into the realm of providing medical expertise in an area where he was not legally certified to engage in.

Remember, giving your opinion about a health-related subject or telling about your specific experience is one thing but if you are claiming to be an expert in anything on your health and nutrition website, you could be held accountable by the boards who are responsible for governing the public education on the subject and run into legal issues.

You must not in any way claim or pose as something you are not if you are going to provide reliable health information.

If you are handing out health or wellness advice you need to be very clear about what your education and expertise are and also be very careful of the legal issues …

We are really out of shape! According to the Centers for Disease Control and Prevention, two out of every three Americans are overweight and one-third is clinically obese. Regular exercise would greatly improve the situation, but according to the American College of Sports Medicine, less than half of all Americans get the recommended amount of exercise. This is compounded by the fact that more than 50% of the people who begin an exercise program abandon it within the first six months. This happens for five primary reasons: injury, a lack of time, boredom, a lack of support and a lack of motivation. The good news is there are specific steps we can take to address each of these problems.

1. Injury. Injuries are the single biggest reason people abandon their exercise programs. An injury can include significant damage to muscle tissue such as a sprain, or the minor muscle damage that causes soreness. Either situation can diminish your motivation to exercise. The most effective way to deal with injuries is to avoid them. You can do this by warming up before exercise, by starting with a simple exercise regimen and expanding it over time, by learning the proper form for every exercise, and by engaging in a variety of aerobic and strength training activities.

2. A Lack of Time. The number one excuse for not exercising is, you guessed it, a lack of time. No one ever thinks they have enough time to work out but the truth is, you only need to spend about 30 minutes, 5-6 days-a-week to get significant health benefits from exercise. In addition, you don’t need a formal exercise regimen. Instead, try to make increased physical activity a part of your daily life. You can do this by cycling to work or school, by engaging in physical activities with your children (e.g., throwing a Frisbee), by participating in sports activities you enjoy (but be careful, this is how injuries often occur), by walking on a daily basis, or by doing household activities (e.g., mowing the lawn, shoveling snow).

3. Boredom. Another reason people stop exercising is because they get bored. Therefore, it is important to have variety in your physical activities. Try to do different exercises day-to-day or week-to-week. Select activities you enjoy, not those someone else says you should do. Remember, there is no best exercise. Anything that gets you moving will enhance your fitness and overall health.

4. A Lack of Support. It is difficult to engage in a successful, long-term exercise program without the psychological support of your family, friends and even co-workers. Develop this support by exercising with others. This is especially powerful early in your exercise regimen. It is much harder to skip a workout if you have one or two friends exercising with you.

5. A Lack of Motivation. Each of the aforementioned factors can have a negative impact on your motivation to exercise. However, at the end of the day, you must define your reasons for exercising. Are you trying to get into shape for an athletic event? Perhaps you want to look better for an upcoming social engagement. Maybe you want to reduce your risk for disease. Whatever your reasons are, clarify them in your mind and always keep them in front of you. One way to do this is to write down your reasons for exercising and post them in highly visible areas. This will give you a constant reminder of why you are exercising and can motivate you to continue through difficult periods when your enthusiasm is low.

The Hayband and Qu-Chi Band are a natural alternative to help relieve the symptoms of hay fever. There are many remedies on the market including tablets and nasal sprays however the hayband is completely natural and is suitable for children.

The Hayband and Qu-Chi Band work by placing pressure on the Qu-Chi point, a point in the crux of the arm which is used in Acupressure. They are both a highly effective, clinically tested, drug-free product to help with hay fever relief and aid the relief of symptoms of Allergic Rhinitis.

The bands are fast acting and should be worn before symptoms start, however they can be worn once symptoms of hay fever are noticed. The bands are very easy to use. Once in place just underneath the elbow joint, you can wear either band day and night without noticing it’s there. The Qu-Chi band or The Hayband can be worn on either arm and is suitable for people of all ages. The great thing about the Hayband and Qu-Chi bands is that they can both be used in conjunction with other hay fever medication or simply on their own. The bands do not cause drowsiness so are ideal for children and adults alike.

Both the Hayband and Qu-Chi band is machine washable so they can be used again and again until the hay fever season is over. One size fits all so there is no need to worry about the band not fitting properly. Hay fever is caused by an allergy to pollen. Common symptoms are a runny, itchy and/or blocked nose, sneezing, and itchy eyes. The condition is caused by an allergy to pollen and the symptoms are due to the immune system reacting to the pollen. Cells on the lining of the nose and eyes release histamine and other chemicals when they come in contact with pollen. This causes inflammation in the nose (rhinitis) and eyes (conjunctivitis). Sometimes the sinuses and throat can also be affected.

Hay fever [http://www.healthandcare.co.uk/hayfever/the-original-qu-chi-acupressure-band.html] is also called seasonal allergic rhinitis because symptoms tend to occur at the same time, or in the same season, each year. It is very common. It affects 2 in 10 people in the UK. It often first develops in school age children and during the teenage years.

Off-gassing has been floating around online as something we should fear from our carpeting. But first, what is off-gassing anyway? Off-gassing refers to possible volatile organic compounds or VOCs and chemicals being emitted from new furniture or similar household materials. Some people confuse that new carpet smell with the off-gassing of VOCs. But, let’s take a look at the facts.

If one looks up the term “off-gassing,” they will likely be met with scary headlines that claim household materials can cause serious health issues. These are some frightening claims, but as many of us would like to install new beautiful carpeting in our homes, it’s important to get at the truth and take some time to address these concerns.

First, it is said that carpet is one of the lowest emitters of VOCs (volatile organic compounds) among household furnishings and building materials. And, carpeting sold at trusted flooring companies goes through extensive indoor air quality tests before it even reaches the stores. An easy way to find out the level of standards for a particular carpet is by looking for a green label. ‘ Green Label,’ from the Carpet and Rug Institute, ensures that customers are purchasing the lowest emitting carpet, adhesive and cushion products on the market.

All-in-all, new carpet smell does not equal leaking chemicals. And, claims that formaldehyde is being emitted by off-gassing, another thing one might find online, is simply untrue. Formaldehyde is not a concern as it is no longer used in the manufacturing process in the United States. In fact, scientific studies now show that carpet is one of the lowest emitters of volatile organic compounds (VOCS) into the indoor environment. And, carpet has recently been proven to emit less VOCs than other household interior products like wall paint.

Although some love that new carpet smell, it may not be everyone’s favorite aroma. If this is the case, it is a good idea to open the windows after a carpet installation to allow the room to air out for a while. What VOCs new carpet may emit are short-lived and largely dissipate within 24 to 48 hours. And, this occurs even faster with fresh air ventilation.

The best way to find out about the safety of carpeting for the home is by speaking to carpet professionals and by asking questions. Flooring and carpeting professionals are well-versed in all things carpeting and will be able to address your concerns. They should be able to show you proof that the carpeting you’ve chosen has been given the Green Label and has gone through the proper testing.

The direct commitment of senior management and the participation of employees in the development of workplace health policies are an essential prerequisite to the successful implementation of policies that are designed to address the real needs of the working community.

The following main steps and/or activities should be considered in the development and implementation of workplace health management at the enterprise level:

· Develop a short policy statement from the employer or senior executive that explicitly states senior management’s commitment to and acceptance of responsibility for the health management strategy within the company.

· Educate managers and workers on the impact of environmental, occupational and lifestyle factors on their health and social well-being and on the economic situation and competing ability of the company to facilitate their participation in health management.

· Determine the role of the medical, nursing, environmental and safety experts and other professionals needed to assist in the implementation of the health management strategy in the company.

· Discuss economic appraisal of existing and projected outcomes to health, safety, and environmental health from the activities of the company.

· Train staff in quality management principles and standards to be used for the workplace health management system. These are the same as those applied to quality assurance in the management of manufacturing, servicing or marketing operations.

· Assure participation of management and employees in the development and implementation of workplace health management systems in the company.

· Develop adequate tools for monitoring and evaluation of health, safety, social, economic and environmental outcomes to determine the impact on well-being of employees and competitiveness of the company.

· Introduce systematic internal auditing and evaluation to be able to make necessary adjustments to the workplace health management system of the company.

· External audit by a recognized certifying body, if necessary.

Key steps in implementing workplace health Policies

The prerequisite for establishing good practice in workplace health management in companies is the conscious and creative support as well as the fullest possible participation of senior management, employees and their trade union representatives.

They would co-operate in the development of the workplace health policy and in its implementation with the assistance of appropriate experts, e.g. from occupational health services, environmental health services or health promotion agencies, preferably from multidisciplinary preventive services. Quality management systems and internal and external auditing is believed to be supportive to the creation and maintenance of a healthy enterprise. Leading companies are increasingly integrating their health management and environment management into the overall corporate management system. The health and environment policy of the company determines targets, define processes, and assure financial and human resources necessary to act on the health determinants and improve social and physical environments in order to:

  • Create the greatest gain in health and working ability for the entire staff, and if possible, also for their families
  • Provide a safe and healthy working environment for employees while preserving the general environment and health of people living outside the premises
  • provide healthy and environmentally friendly products and services
  • ensure human rights of the entire staff

Many churches across the country are using faith to inspire people to start a fitness program.

We all know that fitness is a major key to your health and wellness, and churches are tying it to a ministry because members want to be spiritually fit, as well as physically fit.

Faith based fitness ministries are reminding followers that their bodies are temples of the spirit. Many of them cite research that links health, prayer and stress management and believe that spiritual motivation can inspire health changes that exercise alone can’t accomplish.

“Unless you are both spiritually and physically fit you really aren’t ‘fit’,” says Dr. Kenneth Cooper, known as the father of aerobic exercise movement and who was among the first to articulate the connection between fitness and religion.

What are some distinctive qualities of faith that are important to faith-based fitness?

Dr. Cooper adds “our bodies don’t last because of the way we treat them. Moderation in the consumption of alcohol [is important]. In my basic rules of wellness I list proper weight, diet, nutrition along with exercise, elimination of tobacco and drugs, stress management, and then have periodic wellness examinations. Look at those. They have a spiritual base.”

Many churches are offering numerous of fitness programs including, yoga, boot camps and marathon training to name a few. There are also team sports such as basketball, volleyball and softball for all ages.

Corporate American is getting involved also. This past January, Charter Communications teamed up with the Trinity Broadcasting Network (TBN) to become involved with it’s ‘Get Hooked on Health’ St. Louis Expo.

The goal of the Expo was to encourage the people of the St. Louis community to make healthy lifestyle choices in the areas of nutrition and exercise. TBN’s presence has motivated many people to activate their faith and to empower a positive health transformation.

Experts feel that being fit both spiritually and physically can add on nine more years to your life. Kym Hunter, who attends The Church on the Rock in St. Charles, MO, says “It is God’s mandate for us to have a healthy temple; this is our way of leaving our legacy. We want to be healthy, strong in the body of Christ. If I am healthy, then I can help others and save others in whatever conditions they are going through as well.”

Just what is emotional health? How can I have good emotional health?

1. Take care of yourself.

Believe it or not taking care of your body also helps take care of your mental health. Watch your diet! Eating too much of one food, having too much caffeine or having too little protein can have a negative influence on your emotional health. Exercising your body also gives you a stronger, confident sense of self. The simple act of walking has been proven to be connected to your mental health. Get up and move!

Don’t forget to sleep! Sleep is an integral part of mental health and may even be more important that what you eat. Not getting enough sleep can actually change your personality, so work on saving that time. Take 8 hours just for your sleep so you can approach the day with better emotional/mental health.

2. Develop good relationships with friends and family.

Feeling alone is worse than being alone when you know there are people out there who love you. Part of not feeling alone is taking it upon yourself to create and maintain good relationships with others. This is just one way in which you maintain a support system.

Having a support system is like having a wall with people standing on either side to keep it standing. Sometimes we want to be that to others, but we need to be able to allow others to be our support as well.

3. Follow the Doctor’s orders!

It may be that you take some medication. If you take medication, don’t stop taking it without asking the doctor for permission. Sometimes medicine has two purposes. Some Epilepsy medications may also act as a mood stabilizer, so going off of it may impair your mental and physical health.

Also, if you do not take the medicine you need, your health may become worse. If you are taking medicine to maintain your mental health, remember that it works because you are feeling OK and it is not that you don’t need the medicine.

4. Set Goals

When you look towards the future, what do you see yourself doing in the near one year down the road. How about 5 years, 10 years? Setting a goal gives you something to work towards, it allows you to see what can be if you want it bad enough!

5. Do something for others! Do something for you!

Many times you will hear, you need to take 5 minutes and do something just for you. Try doing for others instead. Unselfish acts of caring and generosity can provide you with an emotional charge that will “kick start” you through the week.

If you seem to be spending a lot of time doing for others and still have a high stress level, try doing something for just you. If doing something for you means you need to take a nap, have some alone time, take a vacation, these actions for you are important. They are opportunities to recharge your batteries and prepare for the next adventure in life.

Boot camp fitness programs are scientifically designed workouts to suit a wide range of people who value physical fitness and are serious about remaining physically agile and trim. The fitness programs may vary in style, rigor and intensity to meet individual needs. Boot camp techniques and exercises can burn the extra fat and calories and also initiate you into a different lifestyle.

Losing weight and getting into shape seems nearly impossible for a lot of people and the only way to achieve results is through enforcing discipline and the fitness boot camps just do that. Understanding what needs to be done to make you physically fit and trim is winning half the battle and fitness boot camp trainers know what you need to do.

Boot camp fitness participants are made to perform a wide assortment of strengthening, stretching, and cardiovascular drills, so the entire spectrum of bodily fitness – anaerobic, aerobic, and mobility – is trained with every session.

Not long ago, boot camp fitness programs were terribly excruciating and you almost killed yourself with workouts that largely resembled the rigorous military training imparted to soldiers. Things have changed a lot and in a fitness boot camp, you need no longer train like a soldier to lose weight and get into proper physical shape. But still boot camp fitness programs are challenging and you need a lot of self-discipline.

Boot camp workouts are productive because you work your entire body-nerves, tissues and muscles-through successive exercises one after the other with no respite in between. The workouts involve jumping jacks, crunches, body-weight squats, push-up with rotation, single-leg straddle, step jumps, explosive push-up, running, bicycling and lot more.

In boot camp, the challenge is to test your physical endurance and to take your body to its farthest limits. They are are aimed at:

• Effectively burn out a lot of unwanted calories leading to shedding of excess fat

• Making you work your entire body within in a short span of time and increase your powers of endurance and enhanced muscle strength

• Having each exercise differently so that you are not bored and remain enthusiastic

• Keep you motivated as you will do the workouts in the company of peers

• Easy to perform exercises that you can do anywhere with little equipment

• Boosting your levels of self-confidence and achieving overall body fitness

Some select fitness programs for free fitness assessments to determine the type of workout you will require and also supply participants with nutrition booklet including guidelines & tips to speed up results.

Each person’s program is individualized to make it result-oriented – from the type of food and nutrition and the physical workout program design and behavioral education and changing of lifestyle. Before enrolling in fitness programs, please verify if they are reliable and whether they have qualified nutritionist, therapist, trainers and other health care professionals.

Make sure the trainers at these fitness camps also undertake to build a program for you to pursue even after the session is over so that you sustain the levels of physical fitness you attained at the camp. This is critically important if attending a fitness camp is to guarantee long-term benefits and you get your money’s worth.

The primary objective of the Occupational Health and Safety Act is to ensure that safety at work is achievable in every organization big or small. By complying with this act, you can address issues that may pose danger to your employees, well before any untoward incidents occur.

Workplace inspections serve a critical role in fulfilling this objective and in maintaining a safe, productive work environment where your business can flourish. These are planned walk-through activities carried out in the work premises to critically examine various factors. Some of the aspects that may be covered are materials, buildings, equipment and so on which may potentially pose danger.

One should call in competent, experienced, safety consultants to outline how an effective safety inspection should be carried out for your workplace. Keep in mind that the nature of business, the kind of processes involved here, the kind of equipment being used etc have an impact on which aspects need to be covered during your workplace inspections.

Planning your Inspections

To carry out a truly effective inspection, it needs to be thoroughly planned where every important aspect is taken into consideration. Hiring experienced safety consultants is good move because they can bring in their expertise to point out various aspects that you may not have considered. In addition, you can have your own team enrolled in health and safety officer courses with these experts to learn how periodic inspections should be carried out to curb the risks in the workplace.

Establishing acceptable standards for various workplace activities, processes and the environment, in general, is a key component of workplace safety planning process. With the standards in place, it becomes easier for your employees and your inspectors to quickly identify increased risk in any area well in advance, so that it can be rectified before it causes any harm.

The Occupational Health and Safety Act Guide has been prepared to assist employers, workers, constructors, supervisors, owners, suppliers, and others who have duties under the Occupational Health and Safety Act.

The purpose of the OHS Regulation is to promote occupational health and safety and to protect workers and other persons present at workplaces from work-related risks to their health, safety, and well-being.

The occupational health and safety professional plays a major role in the development and application of accident investigations, risk assessments, loss prevention, and safety training programs for workers. They develop programs that will in conserving life, health and property; improve productivity by implementing loss-control programs in consultation with company and labour officials; identify health and safety hazards in the work environment and advise corrective action.
